Dylan Pine

Dylan, the director of Clendon Webb, founded the firm after recognizing a gap in the legal market for clear, comprehensive litigation advice with a focus on commercial outcomes.

As an experienced litigation and dispute resolution lawyer, Dylan is admitted to practice in both New Zealand and Samoa. He regularly appears in civil and specialist courts.

Recent Experience

    • Representing the directors and majority shareholders of a New Zealand company in a successful application for an ex-parte mandatory injunction and indemnity costs against a minority shareholder to protect the company’s commercial interests.

    • Acting for a company in a dispute with a minority of its shareholders involving interpretation of the shareholder agreement and complex expert financial analysis and valuation.

    • Acting for a company to obtain urgent injunctive relief to allow a significant Auckland construction project to continue. This matter involved a number of parties and was factually and legally complex.

    • Representing the majority trustees of a high-value trust in relation to an injunctive application brought by a trustee seeking to restrain the trust from engaging in a large commercial project.

    • Acting for a beneficiary of a family trust in an application to remove and replace trustees. The litigation involved beneficiary rights, trustee duties, and the question of property ownership.

    • Representing a beneficiary in litigation involving an application to the High Court to review a trustee decision.

    • Acting for a beneficiary in a large family and commercial trust in litigation involving fiduciary obligations owed by the trustees.

    • Advising companies on employment matters including restructures, compliance with New Zealand employment legislation, union negotiation, and employment disputes.

    • Acting for a significant employer in jurisdictionally complex proceedings involving the application and enforcement of confidentiality agreements.

    • Representing an employee on appeal to the Employment Court involving close analysis of internal company policies and their application to the question of unjustified dismissal.

Harrison Sutcliffe

Harrison, a solicitor at Clendon Webb, specializes in complex civil litigation.

He has successfully represented clients as counsel in both the District and High Courts of New Zealand and has assisted senior counsel in multiple appellate matters, including cases before the Court of Appeal.

Harrison is recognized for his commercial approach to resolving complex disputes, drawing on his combined expertise in finance and law.

    • Successful appearance as counsel in High Court proceedings opposing an application by two companies seeking to stay liquidation proceedings and restrain advertising.

    • Assisting senior counsel with the representation of a property company defending multiple sets of proceedings in the District Court and High Court involving complex construction and contract issues.

    • Assisting senior counsel with the representation of a significant property developer defending liquidation proceedings and preparation of appeal to the Court of Appeal on issues involving the statutory demand process.

    • Assisted with the defence of a high-profile senior executive in the context of allegations of breaches of accounting standards.

    • Acting for a plaintiff on successful summary judgment claim in defamation relating to statements published by a New Zealand based publisher. In granting summary judgment, the Judge noted that were not aware of a summary judgment application for defamation being successful in New Zealand previously.

    • Appearance as junior counsel in a successful application for interim name suppression for senior executives of a well-known New Zealand brand in the context of criminal proceedings.

    • Assisted with a successful appeal to the Court of Appeal on the question of permanent name suppression on behalf of a defendant in criminal proceedings.
